Acceptance of Terms

By accessing or using the Taco Mac Wingman Rewards mobile app, website, or program (collectively, the “Program”), you agree to these Terms and Conditions (“Terms”) and our Privacy Policy. If you do not agree, please do not use or participate in the Program. Your use of the Wingman Rewards app is also governed by the Taco Mac Privacy Policy, which explains how we collect, use, and protect your personal information. The Privacy Policy applies to all Taco Mac websites, mobile applications, and loyalty programs, including Wingman Rewards. Please review it carefully.

Eligibility

Participation is open to individuals 18 years of age or older who reside in the United States. The Program is valid only at the Taco Mac Pelham, Alabama location.

Program Overview

Wingman Rewards is a customer loyalty program that allows members to earn points for qualifying purchases and redeem them for rewards, subject to these Terms. Participation is voluntary and requires a registered account. Rewards and benefits may vary and are subject to change or discontinuation at any time without notice. The Program is currently valid exclusively at Taco Mac Pelham, Alabama. Points, offers, and rewards earned in Wingman Rewards are not transferable or redeemable at any other Taco Mac location or in other loyalty programs, including Brewniversity.

Non-Alcoholic Purchase Compliance

In compliance with Alabama Alcoholic Beverage Control (ABC) regulations, rewards may not be earned or redeemed for the purchase of alcoholic beverages. The Program applies only to qualifying food and non-alcoholic beverage purchases.

Account Registration

To enroll, users must create an account in the Wingman Rewards app or website. You agree to provide accurate information and maintain the confidentiality of your login credentials. Taco Mac is not responsible for unauthorized account use.

Data Security and Privacy

Taco Mac takes reasonable administrative, technical, and physical safeguards to protect Member information collected through the Wingman Rewards app or website. By participating in the Program, you agree to the collection, use, and storage of your data in accordance with the Taco Mac Privacy Policy.

Earning and Redeeming Points

Members earn 10 points per $1 spent on qualifying purchases (excluding alcohol, taxes, and gratuity). Rewards may be redeemed only at the Pelham, AL location during dine-in transactions. Points and rewards have no cash value and cannot be transferred, sold, or combined with other promotions. Taco Mac reserves the right to adjust or revoke points due to error, misuse, or fraud.

Expiration of Points: Points that remain unused for 12 months from the date they were earned may expire at Taco Mac’s discretion and cannot be reinstated once expired.

Prohibited Conduct

Users agree not to misuse the Wingman Rewards app or engage in fraudulent, misleading, or unlawful activity. Prohibited actions include, but are not limited to: creating multiple accounts, using bots or scripts to earn rewards, tampering with app functionality, or attempting to gain unauthorized access to Taco Mac’s systems. Taco Mac reserves the right to suspend or terminate any account involved in such activities.

Account Suspension, Termination, and Program Changes

Taco Mac reserves the right, at its sole discretion, to suspend, limit, or terminate any Member’s account or participation in the Wingman Rewards Program at any time, without notice, if it is determined that the Member has violated these Terms and Conditions, the Privacy Policy, or any other applicable policy or terms of use, or if the account has been used in an unauthorized, fraudulent, or otherwise unlawful manner.

Points or Rewards that were incorrectly issued, obtained through misuse, or awarded due to error may be adjusted or revoked at any time. Taco Mac may also cancel or remove Points and Rewards from an account if it determines that the Member engaged in conduct inconsistent with the intended spirit or fair use of the Program.

Taco Mac reserves the right to change, modify, or update the Wingman Rewards Program, its rewards, or any related policies at any time and for any reason, with or without prior notice. Such changes may include, but are not limited to, modifications to how Points are earned, calculated, or redeemed; updates to reward values or expiration dates; adjustments to available benefits or promotional offers; or the combination or replacement of this Program with another loyalty or promotional program.

If the Wingman Rewards Program is discontinued, all unredeemed Points and Rewards will immediately expire and have no cash or redemption value.

Taco Mac also reserves the right, in its sole discretion, to discontinue the Wingman Rewards app, website, or any related digital services, or to restrict access by any user, with or without notice. Members acknowledge that Taco Mac shall not be liable to any individual or third party for such suspension, modification, or termination of the Program, Rewards, or related services.

Communications

By enrolling, you consent to receive communications from Taco Mac, including marketing and promotional messages via email, push notifications, or text messaging. You may opt out of marketing emails at any time via the unsubscribe link or update your preferences in your device settings. For text messages, you may reply STOP to opt out at any time. Message and data rates may apply.

Third-Party Services

Certain features within the Wingman Rewards app, such as loyalty management, geolocation, push notifications, or analytics, may be supported by authorized third-party service providers that process data on Taco Mac’s behalf in accordance with the Taco Mac Privacy Policy and applicable data-protection laws. Taco Mac is not responsible for third-party websites or services linked within the app, and use of such services is subject to their respective terms and privacy policies.

Intellectual Property Rights

All content, trademarks, logos, and other intellectual property displayed within the Wingman Rewards app or related materials are the property of Taco Mac or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the app for personal, non-commercial purposes in accordance with these Terms. You may not reproduce, modify, distribute, or exploit any part of the app or its content without prior written consent from Taco Mac.

Disclaimer of Warranties

The Wingman Rewards app and all associated content are provided on an “as is” and “as available” basis without any warranties of any kind, express or implied. Taco Mac does not warrant that the app will be uninterrupted, error-free, or secure, or that rewards or offers will always be available. Your use of the app is at your own risk.

Limitation of Liability

Taco Mac is not liable for any technical issues, delays, data loss, or unauthorized access that may impact participation in the Program. In no event shall Taco Mac’s liability exceed the value of the unused rewards in your account.

Indemnification

You agree to indemnify, defend, and hold harmless Taco Mac, its affiliates, officers, employees, and agents from and against any claims, damages, liabilities, costs, or expenses arising out of or related to your participation in the Wingman Rewards program, violation of these Terms, or misuse of the app.

Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Jefferson County, Alabama.

Severability and Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Taco Mac regarding the Wingman Rewards program.

Changes to These Terms

Taco Mac may update these Terms periodically. The revised version will include an updated “Effective Date” and will be posted within the app and on Taco Mac’s website. Continued use of the Program constitutes acceptance of the revised Terms.
